Terms of Service

Welcome to CastandCurtain. By creating an account or using this service you agree to these terms. If you don't agree, please don't use the service.

These terms are a legal agreement between you and CastandCurtain ("we", "us", "our"). "You" means the person or entity using the service.

1. The Service

CastandCurtain is a hosted portfolio platform for musical theatre performers. When you sign up you get:

  • A subdomain at yourname.castandcurtain.com
  • An admin dashboard to manage your site content
  • The option to connect your own custom domain
  • Additional features depending on your plan (see Section 6)

We may add, change, or remove features over time. If a change materially reduces what you're getting, we'll give you reasonable notice.

2. Account Responsibilities

You are responsible for:

  • Keeping your login credentials confidential. Don't share your password.
  • Keeping your email address current — we use it for billing notices, security alerts, and important updates.
  • All activity that happens under your account, whether or not you authorised it.
  • Everything you publish on your site (text, images, audio, video, links).

If you think your account has been compromised, contact us at support@castandcurtain.com immediately.

3. Acceptable Use

CastandCurtain is a portfolio platform for performers. You may only use it for that purpose. You must not:

  • Publish illegal content of any kind.
  • Harass, threaten, or discriminate against anyone on the basis of race, gender, religion, nationality, sexual orientation, disability, or any other protected characteristic.
  • Post spam, unsolicited advertising, or phishing content.
  • Distribute malware, viruses, or any harmful code.
  • Infringe anyone else's copyright, trademark, or other intellectual property.
  • Impersonate another person, performer, or organisation in bad faith.
  • Publish adult or sexually explicit content.
  • Attempt to access, probe, or breach the security of our systems or any other tenant's account.
  • Scrape, crawl, or automatically harvest data from our platform or other tenants' sites without permission.

We can suspend or permanently delete accounts that violate these rules, at our discretion and without a refund.

4. Your Content

You own your content. Anything you upload or create on CastandCurtain belongs to you. We don't claim ownership over your headshots, bios, résumés, or anything else.

By using the service, you grant CastandCurtain a limited, non-exclusive, royalty-free licence to host, store, display, and process your content — but only to the extent necessary to provide the service to you. We won't use your content for advertising, train AI models on it, or sell it.

You confirm that you have the rights to everything you publish. If you include other people's photos or music, make sure you have permission.

5. Subdomains & Custom Domains

Your subdomain

Subdomains (e.g. jane.castandcurtain.com) are assigned on a first-come, first-served basis. We may reclaim a subdomain if it clearly impersonates a real person or brand in bad faith, or if the account has been inactive for more than 12 months after cancellation.

Custom domains

You can connect a domain you own. Registering and renewing that domain is entirely your responsibility. We can't be held responsible if your custom domain expires or its DNS changes.

6. Plans & Billing

This section is important. Please read it carefully. It explains exactly how and when you'll be charged.

Plans and prices

We offer two monthly subscription plans (prices in USD):

  • Standard — $19/month. Full self-managed portfolio site with all core features.
  • Managed — $39/month. Everything in Standard, plus our team helps set up and maintain your site.

Prices are shown exclusive of any applicable taxes. Taxes are added at checkout based on your location.

Free trial

New accounts get a 3-day free trial. No credit card is required to start your trial.

If you add a payment method and subscribe during or at the end of the trial, your first paid billing period begins on the day you subscribe. If you don't subscribe before the trial ends, your account access is suspended until you choose a plan.

How recurring billing works

Subscriptions are monthly and auto-renewing. Here's the simple version:

  • Your billing date is the calendar day you first subscribed (e.g. if you subscribed on April 14, you'll be charged on May 14, June 14, July 14, and so on).
  • We charge your card automatically on that date each month.
  • If your billing date falls on a day that doesn't exist in a given month (e.g. the 31st in February), you'll be charged on the last day of that month.

Payment processing

Payments are processed by Stripe. Your card number is stored securely by Stripe — we never store or see your full card number. By providing a payment method, you authorise us to charge it each billing period.

Cancellation

You can cancel anytime from the Billing page in your dashboard. When you cancel:

  • Your subscription stops renewing.
  • You keep full access until the end of the current paid period.
  • We don't issue refunds for the remaining days in a paid period.

Failed payments

If a payment fails, we'll retry automatically over the following days and notify you by email. After a grace period of 7 days, your account is suspended until payment succeeds. We won't delete your account immediately — see Section 9 for what happens to your data.

Price changes

If we change the price of your current plan, we'll email you at least 30 days before the new price takes effect. If you don't cancel before the change date, the new price applies at your next billing cycle.

7. Availability

We work hard to keep CastandCurtain reliable and available. That said, we don't guarantee 100% uptime. Maintenance, outages, and third-party failures happen. The service is provided "as is" and "as available" without any warranty of uninterrupted operation.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • CastandCurtain is not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption.
  • Our total liability to you for any claim arising out of or relating to these terms or the service is capped at the amount you paid us in the 12 months before the claim arose.

Some jurisdictions don't allow limitations on implied warranties or liability — if that applies to you, some of the above may not apply.

9. Termination

You can cancel any time

Cancel from your Billing page. See Section 6 for what happens to access and billing after cancellation.

We can suspend or terminate accounts

We may suspend or terminate your account if you violate these terms, fail to pay after the grace period, or if we're required to do so by law. For non-payment, we'll give you reasonable notice. For serious violations (e.g. illegal content, security attacks), we may act immediately.

Your data after closure

After your account closes — whether you cancelled or we terminated it — your content is retained for 30 days and then permanently deleted. During that 30-day window, you can request an export of your content by emailing support@castandcurtain.com. After 30 days we can't recover it.

10. Governing Law & Disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

Any dispute that can't be resolved informally will be settled by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. You waive any right to a jury trial or class-action lawsuit, to the extent permitted by law.

Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

11. Changes to These Terms

We may update these terms from time to time. For material changes, we'll send you an email at least 30 days before they take effect. The "Last updated" date at the top of this page will always reflect the current version.

Continuing to use the service after a change takes effect means you accept the updated terms. If you don't agree, cancel your account before the effective date.
